В статье рассматриваются отдельные аспекты реализации защитником положений ст. 235 УПК РФ. Центральным понятием для статьи является ходатайство. Рассматривается такой вопрос, как основания заявления защитником ходатайства об исключении доказательства в предварительном слушании. Автор анализирует определенные проблемы, с которыми может столкнуться защитник в ходе осуществления своей профессиональной деятельности. В статье содержатся идеи по совершенствованию действующего законодательства.

The article provides a comprehensive analysis of one of the central principles of criminal procedure – the free evaluation of evidence. The authors examine in detail the deep-seated antinomy inherent in this legal phenomenon: on the one hand, the principle provides the investigator with the necessary scope for professional discretion based on inner conviction; on the other hand, this discretion is strictly limited by a system of legal, institutional, and ethical frameworks that form the “contours of legality.” The paper consistently reveals the theoretical essence of the principle, draws comparative legal distinctions in its application at the pre-trial and judicial stages, and systematizes a set of problematic aspects arising in investigative practice. Special attention is paid to contemporary challenges: the impact of digital technologies is critically examined, including the fundamental incompatibility of attempts to algorithmize evaluation with the nature of inner conviction; psychological factors such as cognitive biases and professional deformation (“tunnel vision”) are analyzed; the role of multi-level procedural control (prosecutorial supervision, judicial instances) as an external filter correcting subjectivism is assessed. The authors substantiate the thesis of the dualistic nature of the principle under study, which, being an absolute methodological imperative for understanding the circumstances of the case, is implemented within a strictly delineated legal field designed to guarantee the legality, validity, and fairness of all procedural decisions taken.

The article addresses the problems of proof in criminal cases concerning offences under Part 6 of Article 132 of the Criminal Code of the Russian Federation committed against young children.

Рассмотрены проблемные вопросы получения показаний соучастника преступления при выделении уголовного дела в отдельное производство и использования его прежних показаний в доказывании. Опираясь на позиции, сформулированные Конституционным Судом РФ, автор приходит к выводу о необходимости закрепления в законе конкретных механизмов, наделяющих соучастника при даче им показаний равными с обвиняемым возможностями и гарантиями по осуществлению права на защиту. Также автор выступает за сохранение в числе допустимых доказательств показаний обвиняемого, данных им до «разделения» уголовных дел, предлагая предусмотреть в законе возможность и условия их оглашения.

В статье рассматриваются существующие в настоящее время проблемы законодательного регулирования вопроса допустимости в качестве доказательств результатов оперативно-разыскной деятельности, в том числе полученной таким способом компьютерной информации, препятствующие возможности признания ее электронным доказательством и полноценному использованию в доказывании.

Автор задается вопросом о том, почему законодатель специально обязывает суд проверить заявление о фальсификации доказательства в отличие от утверждения о недостоверности доказательства. В статье утверждается, что смысл такой проверки состоит в том, что подобная процедура установлена ввиду криминализации указанного правонарушения.

The article provides a comprehensive analysis of the institution of the announcement of testimony in court proceedings through the prism of the principle of immediacy of evidence examination and the accused’s right to examine witnesses against him. The legal positions of the Supreme Court of the Russian Federation, the Constitutional Court of the Russian Federation, and the European Court of Human Rights concerning the admissibility of previously given testimony are examined. The author substantiates the necessity of assessing the admissibility of announced testimony based on a set of interrelated criteria, including the objective reasons for a witness’s absence, the sufficiency of measures taken by the court to secure the witness’s appearance, and the existence of compensatory procedural safeguards. The article identifies a legislative gap in Article 281 of the Criminal Procedure Code of the Russian Federation regarding repeated failure of a duly notified witness to appear in court, which leads to inconsistent judicial practice. A proposal is made to amend Part 2 of Article 281 of the Criminal Procedure Code in order to ensure uniformity of law enforcement and compliance with the reasonable time requirement in criminal proceedings.

The article analyzes the criteria for the admissibility of evidence obtained and presented in the framework of “document discovery” / “document production” procedures in international arbitration. Special attention is paid to the normative and doctrinal grounds of admissibility, the role of soft law (IBA Rules on the Taking of Evidence, Prague Rules), as well as typical patterns of abuse of law that arise when requesting and submitting documents. The article proposes the concept of “invariant determinants” of abuse of rights, which are stable characteristics and motives that manifest themselves regardless of the applicable law and institutional regulations, and formulates practical criteria for arbitration tribunals in assessing the good faith of the parties' procedural behavior.

В исследовании представлен авторский подход к моделированию такой правовой категории, как дефиниция «допустимость в уголовно-процессуальном праве» в узком и широком смысле. С помощью метода двухуровневой триадической дешифровки получены определения искомой юридической категории, в связи с чем автором предложено закрепление смоделированной дефиниции в ст. 5 УПК РФ в качестве одного их основных понятий и в ч. 1 ст. 88 УПК РФ найденной правовой категории в качестве базового юридического термина.

Оценка состояния доказанности при подготовке и назначении судебного заседания является фундаментальной задачей суда, от которой зависит справедливость правосудия и защита прав граждан. Эффективное проведение этого этапа способствует установлению истины по делу, предотвращению судебных ошибок и вынесению обоснованных и законных решений. Важной частью этого этапа является проверка законности получения доказательств и их соответствия установленным требованиям Уголовно-процессуального кодекса. Судья должен убедиться, что все доказательства были получены с соблюдением прав участников процесса и без нарушения уголовно-процессуальных норм.

The article examines the problems of using forensic expert conclusions as evidence in criminal cases concerning offences in the financial and budgetary sphere. Seven groups of contradictions have been identified and systematised, including methodological, qualification-related, institutional, and terminological ones. As a set of measures, the following is proposed: reforming the legal regulation of forensic expert activity with regard to the category of budgetary crimes, establishing a state register of validated expert methodologies, introducing the specialisation of “financial and budgetary examination”, legislative regulation of electronic evidence, and the formation of an independent scholarly discipline of judicial financial and budgetary forensic science.

The article examines the legal and technical aspects of obtaining, documenting, and proce-durally formalizing information from social networks and messengers for use as evidence in cases involving the creation of sabotage communities. The paper analyzes the characteristics of sabotage communities in the digital environment and the inconsistencies between existing procedural mech-anisms and modern technical capabilities for obtaining digital evidence. Based on this research, the author proposes an original four-stage model for the procedural use of information from mes-sengers and social networks, including technical recording of digital traces, procedural formaliza-tion of the obtained information, expert examination of digital data, and presentation of evidence in court. The article develops specific proposals for improving criminal procedure legislation aimed at regulating the acquisition and use of digital evidence in the investigation of sabotage-related crimes.

The article is devoted to the results of criminal intelligence and surveillance operations (hereinafter referred to as CISO) in cases of economic crimes, which do not constitute evidence themselves: they acquire evidentiary value only after they are procedurally secured in accordance with the rules established by the Criminal Procedure Code of the Russian Federation. The paper examines the regulatory grounds for such use (Article 11 of Federal Law of August 12, 1995, No. 144-ФЗ on Criminal Intelligence and Surveillance Operations; Article 89 of the Criminal Procedure Code of the Russian Federation), establishes procedural limits for the use of operational materials at the stages of initiating a criminal case and preliminary investigation, analyzes the legal positions of the Constitutional Court of the Russian Federation, and distinguishes between the concepts of " CISO results" and "CISO materials". Four requirements for the legalization of criminal intelligence information on economic cases are identified and characterized, namely: legality, timeliness, completeness, and secrecy. In our opinion, the current version of Article 89 of the Criminal Procedure Code of the Russian Federation requires clarification; the corresponding proposal de lege ferenda is formulated in the conclusion.
