Use of Operational-Search Activity Results in Proving Intent, the Amount of Property Damage and the Link of the Act to Entrepreneurial Activity
Annotation
The paper examines the procedural mechanism for using the results of operational-search activity (OSA) to prove intent, the amount of pecuniary consequences and the connection of the act with entrepreneurial activity. The statistical, substantive and procedural categories of economic crime are distinguished, and a single model of proof is shown to be untenable: the three share a procedural entry point but separate outputs. A typology of OSA results is built according to the procedural source they generate; six indicators of pecuniary consequences are distinguished; the criteria of entrepreneurial connection are shifted from external attributes of business infrastructure to the substance of the obligation. A verification matrix and a draft Article 89.1 of the Criminal Procedure Code are proposed.
