В контексте необходимости решения задач применения административной ответственности и надлежащей реализации основополагающих принципов публично-правового регулирования автор статьи обосновывает вывод об отсутствии в действиях лица, совершившего неуплату административного штрафа в установленный срок при неуказании субъектом административной юрисдикции реквизитов для уплаты в постановлении по делу об административном правонарушении, состава административного правонарушения, предусмотренного ч. 1 ст. 20.25 КоАП РФ.

The article examines the evidentiary aspect of the development of administrative proceedings in the context of digitalization. It emphasizes that digital technologies are only tools, while the core of the process remains evidence and proving. In this context, the article analyzes the specifics of adversarial proceedings and the active role of the court, proof tactics, and the risks of abuse of procedural rights. It concludes with the necessity of preserving the priority of the substantive theory of evidence in administrative proceedings.

Обосновывая необходимость реагирования со стороны суда на нарушения законности в ходе производства по делам об административных правонарушениях, автор приходит к выводу о необходимости законодательного закрепления частного определения как адекватной и должной формы такого реагирования.

Статья посвящена исследованию современного содержания принципа состязательности и равноправия сторон при активной роли суда — единственного специального (самостоятельного) принципа административного судопроизводства, который призван компенсировать изначально существующее неравенство между гражданами и представителями органов публичной власти. Автор рассматривает специфику функционирования принципов административной юстиции в контексте особенностей проявления активной роли суда. Особое внимание уделено анализу положений ст. 14 КАС РФ, которая, по сути, активную роль суда никак не характеризует (не раскрывает), и выявлению некоторых аспектов содержания активной роли суда в административном судопроизводстве.

Based on the analysis of federal laws regulating various types of public service, the study reveals the non-systemic nature of the service-related regulatory framework, manifested in linguistic overload, violations of legislative drafting requirements, excessive cross-references, and the phenomenon of «legislative inflation». It is emphasized that such defects pose a threat to legal certainty and reduce the effectiveness of public service regulation. Concluding that a coherent and logically sound normative foundation for public service must be established, the author substantiates that this objective can be achieved through the adoption of the Public Service Code of the Russian Federation.

The modern judiciary is the key element of a law-governed state ensuring supremacy of law and protection of human rights. The article reviews historical and legal prerequisites for the development of judicial federalism, evolution of the lay justice status, and consequences of centralization of the judicial system. Taking into account the elimination of constitutional (statutory) courts of constituent entities of the Russian Federation and financing of lay justice with the federal budget, the author substantiates the position that, although a justice of the peace maintains the illusory status of a judge of a constituent entity of the Russian Federation, in fact it constitutes the main link in the federal (decentralized) judicial system.

The article examines the role of the justice of the peace in counteracting illegal financial transactions within the framework of writ proceedings. It highlights the significance of the judiciary as an institution ensuring legality, social justice, and financial security, and substantiates the place of preventive measures against unlawful financial activities within the structure of modern judicial policy. The study analyzes the most common schemes involving abuse of writ proceedings, addressing problematic aspects of assessing the indisputability of claims and ensuring proper notification of the debtor. The article formulates proposals for improving procedural protection mechanisms, including expanding the powers of justices of the peace and enhancing interagency cooperation with prosecutorial authorities.

Рассуждая об указанном в названии статьи несколько ироничном и, по большому счету, риторическом вопросе, автор затрагивает проблему достойного материального обеспечения (заработной платы) публичного служащего и аргументирует вывод о ее значительной роли в устойчивом развитии государственного управления.

This article, dedicated to the 80th birthday of Professor Boris V. Rossinsky, analyzes individual areas of his scientific work that have influenced the development of modern administrative law. The article examines the scientist's conceptual approaches to the institution of administrative liability, issues of administrative and legal policy, the importance of direct and backward links in public administration, as well as the problems of digitalization, information, mathematical and systemic models in management activities. The works of B.V. Rossinsky are demonstrated to be characterized by methodological integrity and a stable focus on identifying fundamental problems of administrative and legal regulation. A conclusion is made about the significance of his scientific ideas for the development of the doctrine of administrative law and theoretical understanding of ways to improve public administration.

Статья посвящена исследованию отдельных теоретических и практических вопросов организации и обеспечения безопасности судебной деятельности на территории ДНР, ЛНР, Запорожской и Херсонской областей. В статье рассматриваются вопросы финансирования судов, государственных закупок для обеспечения нужд судебных органов, некоторые вопросы открытости судебной деятельности.

Статья посвящена особенностям правового регулирования и формирования органов судейского сообщества на территории Донецкой и Луганской народных республик, Запорожской и Херсонской областей. Используя исторический, функциональный и сравнительно-правовой методы исследования, автор проводит анализ нормативно-правовой базы указанных регионов до и после их вступления в состав России. По итогам исследования автор приходит к выводу о том, что, несмотря на сложность условий, судебная система России успешно справилась с задачей формирования органов судейского сообщества новых территорий.

Автор анализирует роль добросовестности как важного оценочного понятия в правовом регулировании, необходимого в том числе для обеспечения справедливости и гуманности административного судопроизводства. Рассматриваются конкретные нормы, закрепляющие добросовестность в Кодексе административного судопроизводства Российской Федерации, а также предлагаются возможные изменения в законодательство для ее (процессуальной добросовестности) более полного и правильного обеспечения. В заключение автор акцентирует внимание на значении добросовестности для эффективного функционирования административного правосудия.

The article is devoted to the study of the moral dimension of a justice of the peace’s activity in adjudicating administrative offense cases. In the context of the peculiarities of jurisdiction in administrative proceedings and the role of procedural guarantees for participants, both historical and contemporary aspects of the institution of justices of the peace are analyzed. Special attention is given to the relationship between the concepts of “ethics” and “morality” in the professional activity of a justice of the peace, as well as to the impact of the Code of Judicial Ethics and judicial independence on public trust. Emphasizing the moral aspect of justice in administrative offense cases, the article concludes that justices of the peace are intended to serve as “courts of trust”, combining legality with fairness.

Статья посвящена анализу правового регулирования организации судебной деятельности на территориях Донецкой и Луганской народных республик, Запорожской и Херсонской областей, вошедших в состав Российской Федерации на основании договоров от 30 сентября 2022 г. Автором анализируется историческая последовательность нормативно-правового регулирования организации деятельности судебных органов на указанных территориях, судоустройства и судопроизводства, а также формирования кадрового состава судебных органов. Отмечена преемственность государственной политики в сфере правового регулирования данных вопросов.
