The article examines the constitutional grounds and limits of seizure of digital assets in Russia and Belarus. Regulatory approaches to the arrest and confiscation of cryptocurrency are analyzed, legal uncertainties associated with the decentralized nature of assets are identified, and criteria for the proportionality of restrictions are proposed. The necessity of a balance between public interests and constitutional protection of property is substantiated.
