The legislation of the Russian Federation regulating migration processes provides for a set of competing measures aimed at the removal of foreign citizens and stateless persons. The complexity of applying these legal mechanisms to individuals convicted of crimes is not only due to their diversity, but also to their inconsistency with the procedures for carrying out punishment. Given that the current criminal situation requires the prompt deportation of foreign criminals, the existing regulatory framework allows for the retention of such individuals in the Russian Federation, despite the fact that they have lost their legal grounds for staying in the country.
