The article analyzes procedural violations that are regarded by higher courts as the consideration of a case by an illegal court. Taking into account that the consideration of a case by an illegal court and violation of the rules of jurisdiction entail the same legal consequences in the form of a violation of Part 1 of Article 47 of the Constitution of the Russian Federation, the author concludes that if higher authorities identify these procedural violations, the same procedural consequences should occur.
