This article deals with the principle of separation of powers and its reflection in the constitutional acts. The triad of power put forward by C. Montesquieu — legislative, executive, and judicial power — shouldn’t be deemed as outdated, but at the same time it shouldn’t be dogmatic. Its blind use may hinder the development of state mechanism.
