This article substantiates the application of a systemic approach, developed by the author, to financial and legal science to develop a holistic concept for the legal regulation of the national insurance system in Russia. It is argued that fragmented regulation of individual types of insurance does not meet modern challenges and the state's strategic goals of ensuring maximum insurance coverage for individuals, legal entities, and public entities. A consistent disclosure of the basic principles of a systemic approach allows us to consider insurance as a system.
Based on an analysis of current legislation and existing scientific positions, the author proposes a new methodological tool — a “systemic-institutional” approach. Its novelty lies in its synthesized analysis of financial and legal phenomena using insurance as an example. The author concludes that this approach is the most appropriate and adequate for overcoming the fragmentation of insurance research and developing scientifically sound proposals for improving legislation in this area.
