The article is devoted to the study of the current problem of coercion of employees into voluntary resignation, analyzing circumstances that allow such coercion to be qualified as an abuse of power by the employer. Practical aspects of judicial disputes arising from illegal dismissal are considered. The role of the court in establishing facts of pressure on an employee and restoring their labor rights through declaring dismissal invalid, reinstatement at work, and compensation for moral damage is analyzed. Procedural legal aspects of proving the guilt of the employer, possible evidence, and obstacles faced by workers when defending their interests are discussed. The conclusions presented contribute to a proper understanding of mechanisms for protecting workers' labor rights and serve as a basis for developing effective recommendations aimed at preventing violations of labor legislation and ensuring fair resolution of these disputes in court
