In the article as a part of the discussion about the role of an investigator in Russian legal proceedings and interaction of investigator and court, the author shows that solution of particular cases in legal practice depends on solution of general-theoretical problems. Questions of the said discussion are bound with solution of problems of dialectical approach to legal cases, harmonization of law goals and law enforcers’ goals, the role of judicial norm making in the system of Russian law forms, legal responsibility of investigators, prosecutor, and court, juridical terminology.
