The article argues that ensuring the right of prior and subsequent pledgeholders to participate in foreclosure proceedings on the pledged item may be facilitated by granting courts the authority to obtain information from open sources on their own initiative. The author also concludes that these parties, if they assert independent claims regarding the pledged item after the initiation of proceedings, should be granted the procedural status of co-plaintiffs.
