The article is devoted to assessing the prospects for the adopting in Russian Federation of the Migration Code. Codification is one of forms of systematization of legislation. Administrativists have been discussing the idea of systematization of migration legislation by its codification since the early 2000s that is, almost a quarter of a century. However, this idea was never put into practice. For migration legislation a foreign citizen is basic concept. This concept has a constitutional and legal nature, is based on the norms of article 62 of the Constitution of Russian Federation. On the contrary, the concept of a migrant is not legal, but rather commonplace. Migration legislation must be improved and developed within the framework of legislation on the legal status of foreign citizens in Russian Federation. It was concluded that the adopting of the Migration Code in our country is lack of any prospects.
