The issue of regulating the resistance to unfair behavior in the commodity exchange market is relevant, since unethical behavior on markets that are strategically important for the country's economy (for example, the energy goods market) can lead to price destabilization and reduce the saturation of the market with goods. Currently, the regulation of countering unfair behavior is established by exchange documents, such as the code of ethics. However, legal acts of the Russian Federation do not establish the obligations of exchanges to adopt a code of ethics. The current approach may entail risks for exchanges and trading participants. The author analyzes the problems that arise due to the absence of the obligations and suggests approaches to eliminate the legal uncertainty that has arisen. In particular, the author comes to the conclusion that it is necessary to implement an approach in Russian legislation on organized trading that provides for the introduction of exchange's obligation to establish provisions regulating the ethical behavior of market participants, for non-compliance with which disciplinary measures may be applied.
