As is known, in the absence of direct evidence, the defense opts for a trial by jury. It is also known that in such cases, it is typically extremely difficult for the prosecutor to withstand the consolidated pressure from the defense. In such a situation, the victim is aided by their representative — an attorney performing the function of subsidiary prosecution. The author proposes to amend Article 335 of the Russian Criminal Procedure Code by granting the attorney-representative (in effect, a lawyer-prosecutor) the right to deliver an opening statement before the jury panel.
