The article deals with the views on the legal force of an administrative act in the Austrian scholarship of administrative law, beginning with the 19th century and up until recently. Analyzed are the views of classic Austrian scholars of administrative law and administrative procedure (E. Bernatzik, F. Tezner, R. Herrnritt, A. Merkl), as well as those of later authors, including contemporary ones. As it is exactly these views that have greatly influenced the administrative procedural legislation and the practice of its application, the nature of this influence is also dealt with. The properties of an administrative act’s legal force, derived in the modern-day Austrian legal scholarship, are analyzed as well.
