As a result of a lengthy legislative process aimed at introducing a new legal model into the domestic legal order, ensuring the preservation of major business assets, a set of norms has emerged in civil law governing the legal regime of a personal foundation, which has become a new organizational and legal form of non-profit organization. The legislatively granted ability for spouses to establish a personal foundation complicates the legal regulation of the relevant legal relations, as they fall under the intersecting influence of civil and family law, the priority between which is not clearly defined. Of particular interest in this regard are the legal consequences of divorce and the division of marital property. No less controversial is the question of the fate of a personal foundation established by spouses during their lifetime if the surviving spouse requests the allocation of a share in the joint property. The participation of a notary in legal relations related to a personal foundation facilitates the maximum consideration of the interests of the founder of the personal foundation.
