The article examines the role of the judicial system in the bankruptcy procedure, as well as the effectiveness and efficiency of Russian and foreign systems. The judicial system plays a key role in this procedure by protecting the interests of all parties involved and ensuring fairness. The aim of the study is to analyze the current state of the judicial system in the context of bankruptcy. To achieve this aim, comparative analysis methods and monitoring of current practices were utilized. The results of the research confirm that despite changes in the Russian judicial system, there are still issues that need to be addressed to improve its effectiveness. The area of application encompasses legal practice, as well as research in the fields of economics and law. The novelty of the work lies in the proposed solutions based on foreign experience, which can contribute to the improvement of bankruptcy procedures in Russia.
