Regulatory Support of Trade Union Activities in the Republic of Belarus and the Russian Federation
Annotation
The Russian Federation and the Republic of Belarus are states that have a common history, similar national traditions, culture, and in many ways this was reflected in the formation of national legislation. This article analyzes the normative consolidation of trade union activities in Belarus. It seems interesting to study the legal consolidation of elements of ensuring the right to work and its guarantee through the activities of a trade union organization. This analysis allows us to see the distinctive features in comparison with the Russian model of protecting social and labor rights through the representation of workers’ interests. The article analyzes the main legal acts that determine the legal status of the trade union in Belarus, its role and place in the system of protection and guarantee of constitutional rights, and also uses the comparative method to identify features with the Russian legal model. This problem has not been sufficiently studied in the Russian and Belarusian normative literature, which makes this discussion relevant for the development of constitutional legal science, both in Russia and in Belarus, as well as the teaching of this discipline. The methodological basis of the study consists of an analysis of academic and normative literature and reviews of observational studies, cultural and sociological, combined with critical analysis and comparison, comparative. The center for the study of social and labor relations and problems of the trade union movement at the Southern Federal University, created in 2018, has been analyzing the dynamics of the development of regulatory regulation of trade unions in Russia for 6 years. Currently, there is a need to study modern foreign experience of trade unions and, of course, given the great political and economic rapprochement with the Republic of Belarus, it seems necessary, first of all, to turn to the experience of this state, which will allow us to find growth points for the development of national legislation of the Russian Federation.
