Феномен «кодифобия» в традиции общего права

Annotation

В литературе распространен не совсем верный стереотип о полном отсутствии кодификации в странах общего права как в их историко-правовом опыте, так и в действующем правовом поле этой семьи. В статье описываются защитная, антикодистическая позиция, которую занимают юристы общего права, их главные контраргументы и попытки обосновать основную угрозу идеи кодификации, представляющей квазиугрозу самому духу общего права. Анализируются причины исторического провала кодификационного проекта в Великобритании и на контрасте вполне успешная теоретическая дискуссия и законодательная кодификация в отдельных британских колониях.
