Evolution of the Institution of Public Order in Countries of the Anglo-American Legal Family
Annotation
The paper examines the process of development of the institution of public order in some states of the Anglo-American legal family. The legal systems of the United Kingdom of Great Britain and Northern Ireland, the United States of America, Ireland and Canada were chosen as the empirical basis for the study. The main examples of judicial practice of these states, which contributed to the formation of the institution of public order, are considered. It is concluded that there is no single definition of the concept of “public policy”. At the same time, the public policy of each analysed state takes into account national and local characteristics and conditions, takes into account social, economic and cultural considerations. It is concluded that the role of the institution of public order in national legal systems will significantly increase, becoming one of the basic principles ensuring the protection of national interests and the proper functioning of the state mechanism and legal system.
