«Включающий» и «исключающий» правовой позитивизм: история формирования и концептуальные вопросы
Annotation
В статье исследуются актуальные направления современного англо-американского правового позитивизма — «включающий» и «исключающий» позитивизм. Исследование наследия Герберта Харта как основоположника аналитического направления и трудов его критиков и последователей демонстрирует существование двух названных векторов. Различия между ними проходит в поле правовой аксиологии и фундаментального вопроса зависимости юридической действительности от неправовых аргументов.
