Проблемы признания правосубъектности искусственного интеллекта и ответственности за принятые решения в трудовых отношениях
Annotation
В работе очерчиваются способы решения сформировавшихся и прогнозируемых проблем в правовом регулировании трудовых отношений с использованием искусственного интеллекта. Делается вывод о том, что искусственный интеллект не может обладать правосубъектностью в трудовых отношениях. Предлагается закрепить в трудовом законодательстве презумпцию ответственности работодателя за принятые решения искусственным интеллектом, а также обязать работодателей и разработчиков программного обеспечения сертифицировать протоколы цифровой безопасности программного обеспечения, работающего на основе технологий искусственного интеллекта.
