Компаративистский анализ проблем интеллектуальной собственности в контексте формирования Большого Евразийского Партнерства
Annotation
Статья подготовлена на основе доклада авторов на пленарном заседании XIV Международного Форума «Инновационное развитие через рынок интеллектуальной собственности» (21 апреля 2023 г. на базе МГЮА им. О.Е. Кутафина). В статье подробно анализируются желательные слагаемые преобразования права интеллектуальной собственности на национальном, региональном, межрегиональном и глобальном уровне в рамках Большого Евразийского Партнерства. В их число входит законодательное закрепление механизмов и процедур доступа к высоким технологиям, обеспечения резистентности к наложению санкций на операции с плодами интеллектуальной собственности, установления разумных, рациональных и обоснованных изъятий из режимов защиты интеллектуальной собственности.
