Transformation of the Legal Mechanism for Managing Digital Risks in the Context of Countering External Economic Threats
Annotation
The restructuring of economic relations, driven by the transformation of data into a key production resource, requires a revision of established approaches to risk management. The article examines managerial and legal relations arising in the course of transforming digital risk management mechanisms under the influence of external economic threats. The methodological basis of the study comprises formal legal analysis, systems analysis, the comparative legal method, and legal modeling. As a result of the study, a conceptual model has been developed for integrating the risk management system into data processing processes; key determinants of the transformation have been identified, including a paradigm shift regarding the object of risk, the external economic determinant, and the juridification of technological procedures. The author substantiates the conclusion that the effectiveness of countering external economic threats in the digital sphere depends on a transition from fragmented regulation to the creation of a holistic digital risk management ecosystem embedded in the management decision-making loop.
