Modernization of the Law on Criminal Procedure Conciliation Procedures
Annotation
Purpose: To define the role of proceedings in which plea agreements are entered into between the prosecution and the defence, and to examine the prospects for their further development within domestic legislation. Methodology: General scientific methods of abstraction, analysis and synthesis were employed. Specialised legal methods were also applied. Conclusions. Despite the current trend towards a reduction in the use of criminal procedural conciliation procedures in law enforcement practice, there is a need for their further development. Refining the regulatory provisions contained in the Criminal Procedure Code of the Russian Federation concerning the special procedure for delivering a court judgement where a person pleads guilty to the charges brought against them, as well as when a pretrial cooperation agreement is concluded, will facilitate the continued use of contractual legal means to resolve criminal law disputes that have arisen between the defence and the prosecution. Scientific and practical significance. The scientific significance lies in developing an understanding of the prospects for the application of conciliation procedures in Russian criminal proceedings and in justifying the need to improve the criminal procedural mechanisms contained in domestic legislation. The practical significance lies in the possibility of utilising the author’s conclusions and recommendations both in the course of further academic research and in the process of refining the criminal procedural settlement procedures enshrined in the Criminal Procedure Code of the Russian Federation.
