Digital Rights of Persons Serving Criminal Sentences: A Theoretical and Legal Analysis and Implementation Practice (Part One)
Annotation
This paper presents a comprehensive theoretical and legal analysis of the digital rights of persons serving criminal sentences, as well as suspects and accused persons held in pre‑trial detention facilities. The authors aim to establish the essence of digital rights of convicts, suspects, and the accused, to determine the particularities of their exercise both in conditions of isolation and outside it, and to assess the educational and resocialisation potential of digital law in the penitentiary sphere. In the first part of the article, the authors identify and systematise the key groups of digital rights as applied to convicts, suspects, and the accused: the possibility of using digital technologies and accessing the global network; the right to information security and protection of personal data; freedom of expression in virtual space (within existing restrictions); the right to digital education and improving computer literacy; the right to digital identification; and participation in digital governance processes.
