Problems of the Institution of Preventive Registering of Convicts
Annotation
In scientific studies, preventive registration is interpreted either as a process of collecting information and educational interventions, or as a system of measures, or as a set of measures aimed at preventing offenses. The diversity of approaches stems from the fact that the institution of preventive registration is regulated primarily by bylaws rather than federal legislation, which creates legal uncertainty and room for various interpretations and complicates the placement of convicted persons on preventive registration. The study also takes into account comparative legal perspectives on the organization of preventive registration and oversight mechanisms in various legal systems, allowing for a comprehensive understanding of their role in preventing recidivism. The study identified challenges in registering convicted persons on preventive registration and proposed solutions.
