Annotation

In this article, the author analyzes the conditions, legal consequences, and distinctive features of the termination of criminal prosecution in connection with military service. The author concludes that further comprehensive improvements are needed to the termination of criminal prosecution in connection with military service, including: defining and regulating the circle of persons subject to conscription for military service; developing appropriate criteria for the legal discretion of law enforcement officials in the event of the end of hostilities; differentiating the degree of imperativeness of the application of circumstances specified in the law; and harmonizing the law enforcement activities of authorized persons applying Article 28.2 of the Criminal Procedure Code of the Russian Federation and Article 78.1 of the Criminal Code of the Russian Federation through the interpretation of legislation.
