Design Documentation for Government Contracts: Who Holds Exclusive Rights and How They Are to Be Used in Development Projects
Annotation
The article examines the legal regime of project documentation created under state contracts and analyzes in which cases such documentation or its individual elements may be protected by copyright. It is shown that copyright protection does not extend to project documentation as a whole, but only to an architectural solution as a result of creative work. Particular attention is paid to the distinction between rights under a construction contract and exclusive rights to intellectual property results, as well as to case law involving designers, public customers and developers. Based on regulation and judicial practice, the article formulates practical models for using project documentation in development projects and recommendations on contractual structuring of rights.
