Development of Scientific Ideas on the Subjective Side of an Employee's Disciplinary Offense

The article analyses the subjective side of a disciplinary infraction, focusing primarily on its key component: the employee's guilt. Based on the concept of labour law behaviour and the psychological concept of guilt developed in the general theory of law and specialized legal branches, the author examines the volitional and intellectual elements of the employee's behaviour and guilt in committing an infraction. Furthermore, the article explores the relationship between these elements and the forms and degrees of guilt in relation to disciplinary infractions with formal and material elements. The paper addresses the applicability of mixed and dual guilt concepts, developed in other legal branches, to labour law. It also highlights the practical significance of theoretical legal research on the concept of guilt and other elements of the subjective side of an offence for improving law enforcement practices in employment relations.
