On the Understanding of Civil Procedure at the Turn of the 19th–20th Centuries: A Historical-Legal Approach

Annotation

his study aims to illuminate the historical development of the concept of "civil procedure," highlighting scholars' doctrinal approaches to its content. This allows us to reflect the specific historical and legal characteristics of civil procedure at its inception. Scholarly discussions at the turn of the 19th and 20th centuries focused primarily on the characteristics of procedural legal relationships, the definition of parties, and the role of the court as a representative of the state. The article's methodological framework is based on historical legal, comparative legal, and formal legal methods. The relevance of this work stems from the need to understand contemporary trends in the digitalization of civil procedure within the framework of historically established procedural categories and other legal phenomena.
