Procedural Features of Eliminating Deficiencies in the Operative Part of an Arbitrazh Court Decision

Annotation

The article analyzes the procedural features of eliminating the shortcomings of the resolution part of an arbitral court decision that prevent its enforcement, with a focus on court acts issued under Chapter 24 of the Arbitration Procedure Code of the Russian Federation. The author examines the legislative restrictions that hinder the effective use of the provided procedural mechanisms and illustrates the limits of their application using examples from judicial practice. Based on the results of the analysis, the article raises the issue of the need to reform the legislative provisions governing the elimination of defects in the resolution part of a court decision, as the lack of an effective mechanism for correcting these defects can transform a technical flaw into a significant procedural obstacle to the enforcement of a court decision.
