The article analyzes the role of Rospatent in the intellectual property litigation and in the system of procedural guarantees for their protection. The degree of scientific elaboration of the topic of the system of procedural guarantees for the protection of intellectual rights is shown, its author's concept is given and its content and structure are revealed, a list of procedural guarantees for the protection of intellectual rights and/or their groupings is given. The procedural status of Rospatent is critically assessed when it is involved as a third party in some intellectual property protection cases, using the example of cases on early termination of legal protection of a trademark (service mark).
