The Ethics of Using Neural Networks in Criminal Defense

This article examines the ethical and legal aspects of integrating artificial intelligence systems, particularly neural networks, into the activities of criminal defense attorneys. Potential benefits of using these technologies to ensure the adversarial principle, such as big data analysis, identification of hidden patterns in case materials, and prediction of judicial decisions, are analyzed. Simultaneously, key ethical dilemmas and risks are considered: the “black box” problem and the opacity of algorithms, the threat to attorney-client privilege, and the issue of liability for errors made by a neural network. The author concludes that there is a need to develop professional ethical standards and regulatory frameworks for the application of neural networks in legal practice to minimize risks and realize their potential for protecting rights.
