Annotation

This article provides a comprehensive analysis of abuse of rights in the context of advocacy. The author examines the essence and specific characteristics of this phenomenon, identifies and classifies its main types, and also identifies the systemic reasons for its occurrence in the professional environment of the legal profession. The research is based on the study of legal instruments governing advocacy, the works of Russian and foreign scholars, and judicial practice. The work pays special attention to the contradiction between the principle of maximum protection of the client’s interests and the ethical boundaries of such protection. As a result of the study, the author comes to the conclusion about the need to improve both the legal regulation and mechanisms of internal professional control in order to minimize cases of abuse of rights in legal practice. A classification of types of abuse of rights by lawyers on various grounds has been developed, and it constitutes the scientific novelty of the research.
