This article addresses the current issue of recognizing individuals as bona fide purchasers of real estate when purchasing from a dishonest seller. The article also examines the legal aspects of protecting the rights of bona fide purchasers of housing in real estate transactions complicated by fraud. It analyzes the concept of a bona fide purchaser in Russian civil law, highlights key criteria for its definition, and examines judicial practice in disputes involving transactions involving dishonest sellers. The relevance of this study stems from the significant damage caused to individuals and individuals recognized as bona fide purchasers as a result of fraud and the need to improve mechanisms for protecting their rights. The article analyzes current legislation and judicial practice, identifies the main risks for bona fide purchasers, and develops proposals to improve the effectiveness of legal protection.
