Bank Secrecy and the Risks of Holding Employees of a Credit Institution Liable for Its Disclosure
Annotation
The article analyzes the risks of holding employees of a credit institution accountable for its disclosure of banking secrets. The features of the intersectoral and interdisciplinary nature of bank secrecy are revealed. The circumstances of the disclosure of banking secrecy and the corresponding legal consequences are systematized. The factual circumstances providing for the risk of bringing Bank employees to criminal responsibility for disclosing bank secrets and other issues of assessing the actions of employees of a credit institution in the field of bank secrecy protection are described. Proposals have been formulated to minimize the risks of holding bank employees accountable for disclosing banking secrets.
