Annotation

The article analyzes current trends in the development of Russian criminal legislation on economic crimes, examines problems of criminalization and specialization of such categories, as well as "artificial" competition of general and special norms (using the examples of Articles 159 and 171 of the Criminal Code), identify the risks caused by the broadening of disclosures. Special attention is paid to the dualism of state policy: combination of punitive tendencies with the introduction of liberalizing mechanisms of exemption from liability (art. 76.1 PC). The conclusion is drawn about the situational nature of law-making and the need to develop a common strategy for the development of chapter 22 of the Criminal Code of the Russian Federation based on scientific evidence in order to ensure legal certainty and protect good business. The novelty of the research is based on the author’s approach to the investigated topic, a proposal is made to enshrine in chapter 22 of the Criminal Code of the Russian Federation criminal liability for crimes in the sphere of trafficking in digital financial assets and user-friendly digital rights, by the participants of entrepreneurial and other economic relations.
