Enforceability of Court Judgements in Anti-Corruption Claims: Cross-Border and National Dimensions

The article analyzes the issues of cross-border enforcement of decisions of Russian courts to confiscate assets “legalized” in foreign jurisdictions, in respect of which Russian public officials have not provided evidence of their acquisition on legal income in accordance with national anti-corruption legislation. Given the insufficient effectiveness of the existing model of enforcement of Russian court decisions on anti-corruption claims, the main conclusion is that national enforcement measures in the event of cross-border non-enforcement of the court decisions in question in order to sever the economic and legal connection with the foreign corruption asset should be based on different principles compared to the enforcement mechanism for property located in Russian territory.
