Participation of a Prosecutor in Courts of Review Instances for the Protection of Public Interests

Annotation

In appeal and cassation, the prosecutor's defense of public interests is carried out by appealing court decisions, filing objections to complaints from other participants in the procedure, or by giving an opinion. The first two forms are used in cases initiated by claims of prosecutors, the third, when socially significant or public interests that require protection are affected by the dispute being resolved. The grounds for the participation of the prosecutor in the form of giving an opinion may be: direct indication in the law; the independent entry of the prosecutor into the procedure to protect public interests or the involvement of the prosecutor by the court in identifying circumstances indicating the initiation of a dispute for purposes contrary to public interests. For the conclusion of the prosecutor in cassation and appeal, the written form of its presentation is preferable, and the arguments presented in it should be included within the scope of the verification activities of the courts of appeal and cassation, along with the arguments of complaints and objections to them.
