The Place of the Inheritance Contract Institution of in the Russian Civil Law Theory: From Understanding to Prospects for Improvement
Annotation
This article examines the place of the inheritance contract in Russian civilistic theory. A historical analysis is provided, along with an analysis of the nature of the inheritance contract as an independent instrument for disposing of property in the event of death. A conclusion is reached regarding the need for a legislative and doctrinal distinction between the inheritance contract and the will. The author identifies key theoretical and practical issues that hinder the effective application of the inheritance contract in practice. Based on this analysis, areas for improving the inheritance contract are formulated, including proposals for amendments to civil legislation. The conclusion is drawn regarding the need for a balanced approach to the development of this institution, taking into account the interests of all participants in inheritance legal relationships.
