On the Importance of Spiritual and Moral Values in Intellectual Property Law
Annotation
The article discusses the influence of traditional Russian spiritual and moral values on the legal regulation of intellectual property. The authors emphasize that the content of the norms of Russian legislation regulating intellectual property generally corresponds and is closely related to the norms of international law. However, at the same time, there are norms in this sub-branch of civil law that carry a special spiritual and moral connotation peculiar to the traditions of the Russian legal system. The paper examines the impact of traditional spiritual and moral values that strengthen the country's unified cultural space, civic unity, historical memory, generational continuity and the unity of the peoples of Russia on the norms of Russian legislation governing the creation, use and disposal of intellectual property objects. It is determined that traditional spiritual and moral values have a significant impact on the formation of a person's worldview and moral qualities, and that is why, as well as taking into account the specifics of intellectual property objects, certain restrictions and prohibitions are established at the legislative level in intellectual property law, which, however, are not always observed in practice.
