The Territorial and Legal Complex as an Object and System of Regulatory Control: Issues of the Theory of Natural Resource and Civil Law

Annotation

The article analyzes the legal nature and properties of various natural resource objects characterized by a complex structural structure and spatial organization. The provisions of the natural resource, land and civil legislation of the Russian Federation, judicial practice and doctrinal approaches are studied. The author points out the fragmentary nature of legal regulation and the insufficiency of traditional civil law structures to formalize the status of these territorial and spatial formations. In this regard, the necessity of introducing the category of territorial legal complex (CPC) into legislation is justified as an instrument of comprehensive regulation. A comparative analysis of the TPC and the thing as an object of civil rights is carried out. Particular attention is paid to the relationship between public law and private law mechanisms in the regulation of the CPC, including issues of the unity of the legal regime and territorial borders.
