Development of Inheritance Laws Regarding the Liability of Heirs for the Debts of the Testator in Case of Intestate Succession
Annotation
Over the past decade, a number of new objects of civil turnover have appeared in people's lives, which people use for both personal and work (commercial) purposes). The article discusses the controversial issues of the responsibility of heirsfor the debts of the testator, namely, meeting the claims of creditors of the testator through new types of digital assets. The key problems of the application of universal succession rules in relation to digital assets due to specific characteristics are analyzed. Attention is focused on the contradictions between the need to satisfy creditors' claims and technical limitations regarding the sale of suchassets. The necessity of developing special rules of inheritance legislation for such objects of inheritance is substantiated. The article suggests vectors for the development of inheritance law, taking into account the digital transformation of the economy, aimed at protecting the interests of all participants in inheritance law relations.
