Inheritance Transmission: A Mediative Approach to the Protection of Children’s Interests
Annotation
The article examines the issues of hereditary transmission in the context of protecting the property rights of minors. Based on a real case from legal practice, the author analyzes the conflict between formal civil law rules on inheritance and the need to preserve the economic value of the estate. The effectiveness of a mediative approach is substantiated, demonstrating how it prevents the fragmentation of assets into micro-shares and ensures a balance of interests. A comparative legal analysis of hereditary transmission and alternative dispute resolution in Germany, France, the United States, the United Kingdom and CIS countries is conducted. The mechanism of interaction with guardianship and custodianship authorities when approving inheritance division agreements is described.
