On the Need to Include the Right of Development in the System of Limited Property Rights
Annotation
The article is devoted to the comparison of methods of registration of rights to land plots for the purpose of development. Based on the study of historical experience and foreign legal systems, the author examines the potential of introducing superficies (development rights) into the system of limited property rights. It is concluded that development rights are more relevant than the existing institution of construction lease for solving housing problems and stimulating construction activity.
