The Conflict Between Urban Development Regulations and Civil Law Institutions for the Legalization of Real Estate in Gardeners' Non-Commercial Partnerships
Annotation
The article examines the conflict between the simplified property registration system (“dacha amnesty”) and the substantive legal criteria for unauthorized construction (Article 222 of the Civil Code of the Russian Federation), which leads to risks of demolition for registered properties in gardening non-profit partnerships due to changes in local land use and development rules or the detection of zones with special conditions for land use. Based on recent judicial practice, including Resolution of the Plenum of the Supreme Court of the Russian Federation No. 44, the author proposes legislative amendments to protect bona fide property owners, including the introduction of “immunity from demolition”.
