The Impact of Digitalization on the Principle of Access to Justice

The article examines the impact of digitalization on compliance with the principle of access to justice in the Russian Federation. The author analyzes the constitutional foundations of judicial protection and problems arising from the implementation of electronic document flow in the judicial system. Key contradictions between digital capabilities and procedural legislation have been identified, such as uncertainty regarding the moment of incorporation of electronic documents, lack of unified judicial practice in requiring originals, and limited access to audio and video recordings of hearings in electronic cases. Special attention is paid to the problem of digital inequality and the technical unpreparedness of courts for a complete transition to electronic case management. Measures are proposed to improve legislative regulation and ensure a balance of interests of all participants in the judicial process when implementing digital technologies.
