Delegation of a Legislative Initiative as a Tool for Non-Application of Conditions for Establishing Mandatory Requirements

Annotation

The article examines the practice of transferring draft federal laws developed by the executive branch into the hands of deputies of the State Duma and members of the Federation Council for their subsequent submission to Parliament. It has been revealed that this measure is used on a regular basis in order to accelerate the adoption of legislative changes that may not receive public support due to the presence of many mandatory requirements. As a result, the projected norms may not meet the requirements of the legislative norms established in 2020 in order to minimize administrative pressure on business. According to the results of the study, it is necessary to establish barriers that would prevent the developers of draft federal laws from transferring such projects to other subjects of the right of legislative initiative in order to evade the duties provided for by law.
