Provision of Public Services by the Ministry of Internal Affairs of Russia as a Type of Positive Administrative Proceedings
Annotation
The article substantiates that the provision of public services by the Ministry of Internal Affairs of Russia is an independent type of positive administrative proceedings. Based on the structural and legal analysis, the criteria for such attribution are highlighted: the right-based nature, the absence of a legal dispute, the initiative of a citizen, the regulated nature of production, and the systematic organization of administrative procedures. The dual nature of the Ministry of Internal Affairs of Russia as a subject of public administration combining protective and positive regulatory functions is revealed. The conclusion is made about the need for a theoretical understanding of the “service function” of the police.
